Data transmission systems in the administration

On January 1 of the current financial year the bill 24/2001 of December 27 about Taxation and Administrative measures and Social Order was put into operation. Having been expected by specialists for a long time it is supposed to introduce the inclusion of data transmission media in notary offices, property registers and land registry administrations. These changes allow the usage of electronic data processing systems and transmission technologies with the aim of providing juridical security in the field of notary offices and principally in dealing with registers.

From now on the adminstrations of notary offices and registries are obliged to make usage of data transmission systems in order to carry out the receipt, transfer and dispatch of information which will speed up their actions. If you ask for it, a notary is now able to send your signed contract to the property register via email and solicit the registration or gain information about the mortgage status. It is also possible to send it to a second notary who then issues an authorized copy of the contract. 

This is made possible through the usage of an electronic signature and the cumpletion of a number of requirements: The signature has to be authorized, can only be used for official and public documents and has to be secure in order to provide total security for the clients and the information transmitted.
The new regulation will speed up communication between notary offices and registries and public administration as well as any kind of juridical body by replacing applications on paper which require a long processing time through electronic means. Furthermore, the access to the to be processed data (any type of public document, e.g.. sales, company or inheritance documents) will be a lot easier for the administration.

The law also points out how negociations between notaries of different countries should be carried out. However, the regulations will certainly keep on developing in this area.
By handing in a written agreement, it is now possible to have a look at the land registry's filed data of one's own Real Estate that is not especially guarded. However, administrations in general, public bodies as well as judges and courts do always have direct and unlimited access to them. 
The completion of the progressive regulations will take place as soon as the notary offices, registries and the administration bodies have updated their data processing systems so that the public can soon profit from the already valid legal provisions.
